Supreme Court upholds David Mark-led ADC leadership
The Supreme Court on Thursday upheld the leadership of the African Democratic Congress (ADC) led by former Senate president David Mark, while setting aside the controversial “status quo ante bellum” order which ensued in the course of the ADC leadership crisis.
The apex court held that the preservative directive could not validly survive after concluded proceedings.
Delivering the lead judgement, Justice Mohammed Garba ruled that although courts possess the powers to make preservative orders in protecting the subject matter of litigation, such orders cannot subsist after conclusion of proceedings.
The court therefore upheld the appeal while nullifying the order sustaining the status quo ante bellum in the ADC leadership dispute.
