Court vacates Turaki’s arrest warrant, fixes arraignment for April 22

A Federal Capital Territory High Court has vacated a bench warrant issued for the arrest of the factional National Chairman of the Peoples Democratic Party (PDP), Tanimu Turaki.

Justice Peter Kekemieke vacated the arrest warrant while ruling on an oral application by Turaki’s counsel Chris Uche SAN, following his appearance in court.

Uche, who claimed he was out of the country apologized for his absence on the last date, while also apologizing on behalf of his client who he said has the highest regard for the court, being a SAN himself.

He said Turaki never intended to disrespect the court, adding that his client’s absence was not intentional or deliberate.

Uche promised to withdraw the motion on notice filed by his client for a stay of execution of the arrest warrant, as a show of good faith.

In his response, counsel for the prosecution, Usman Rabiu, stated that the essence of the arrest warrant was to compel the defendant to appear in court, as he was not opposed to Uche’s applications.

In his ruling, Justice Kekemieke noted that Turaki’s reason for absence was still unclear, though his lawyer had apologised. He however pardoned the defendant and proceeded to vacate the arrest warrant.

The judge also struck out a motion on notice filed by Turaki, which sought a stay of execution of the arrest warrant, while adjourning Turaki’s arraignment to April 22.

Justice Kekemieke had on Thursday issued a bench warrant for the arrest of the factional National Chairman of the Peoples Democratic Party (PDP), Tanimu Turaki SAN.

The warrant was issued on the grounds of Turaki’s failure to appear for his arraignment in court, after the Inspector-General of Police charged the PDP Chairman for allegedly providing the police with false information.
